Gateway Mining (ASX:GML) acknowledged breaching Australian Securities Exchange (ASX) listing rule after displaying a slide at a conference indicating its AU$45 million placement had been completed about 17 minutes before the related announcement was released to the market, according to an Australian bourse filing on Tuesday after market hours.

The company said it lodged the announcement at about 9:10 am Sydney time, but its release was delayed, while the chief executive began the presentation believing it would be available beforehand, per the filing.

The company noted that ASX trading had not commenced, and it remained in a trading halt, meaning no trades occurred during the disclosure gap. However, it also acknowledged that this did not remedy the breach, per the filing.

The company said its existing continuous disclosure policy and approval processes were in place while committing to tighter controls.
